Foreclosure for Renters
+
Residential occupants in a residential or commercial property dealing with foreclosure might be safeguarded by NJ's Anti-Eviction statute, N.J.S.A. 2A:18 -61.1 to 61.12. Legitimate residential occupants have rights to remain on the residential or commercial property notwithstanding a foreclosure.
+
Frequently, because lenders don't know occupants' names, the foreclosure problem will call "John Doe, Tenants No. 1 to 10." If a lender is unaware that the residential or commercial property is leased, an occupant may initially be outlined the foreclosure when the loan provider has a writ of possession. See the notice to domestic renters of rights throughout a foreclosure.
